1. Scope
These Terms of Service govern your use of the talkm8 mobile application („App") distributed via the Apple App Store and Google Play, as well as the related website talkm8.app. By installing or using the App you agree to these Terms.
2. Provider
The App is provided by Infin8 World LLC, 7901 4th St N STE 300, St Petersburg, FL 33701, USA („we", „us"). In-app purchases on Apple App Store are processed by Apple Inc.; in-app purchases on Google Play are processed by Google LLC. Payment processing is handled exclusively by the respective store provider.
3. Service description
talkm8 translates spoken language in real time and plays the translation back with synthetic speech. Translation is performed by AI and may contain errors; it does not replace a professional human translation. We do not guarantee 100% uptime.
4. Account and obligations
Use of the App requires an account with a valid e-mail address. You must keep your credentials confidential and must not share them with third parties. Misuse, harassment of other users, or unlawful content are prohibited and will result in account suspension.
[TO REVIEW] Use of the App requires a minimum age of 16. Users under 16 need consent from a parent or legal guardian.
5. In-App purchases (consumables)
The App sells consumable minute packages. Sales run through the store's payment platform; management of purchases (restore, family sharing) follows the rules of the respective provider (Apple or Google).

For consumables, the right of withdrawal lapses once the service has begun. By purchasing, you expressly consent. Unused minutes do not expire while your account is active.
6. Termination and account deletion
You may delete your account at any time. We describe the process in detail on the Account deletion page. Upon deletion, your account, minutes, and token balance are removed permanently; restoration is not possible.
7. Liability
We are liable without limit for damages arising from injury to life, body, or health, and for damages arising from intentional or reckless conduct. For breach of a material contractual obligation due to ordinary negligence, liability is limited to the foreseeable, contract-typical damage. We disclaim liability for the substantive accuracy of AI translations.
8. Changes to these Terms
We may update these Terms where necessary to reflect technical or legal developments, provided you are not unreasonably disadvantaged. Material changes will be announced by e-mail at least six weeks in advance. If you do not object in writing within that period, the new Terms take effect.
9. Governing law and forum
[TO REVIEW] These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the state in which the consumer has their habitual residence is not withdrawn. The forum is Berlin, to the extent you are a merchant or legal entity.
